The administrative court, headed by Judge Fred Nazih Tnago, ruled the refusal of the lawsuit filed by the Egyptian Initiative for Personal Rights to invalidate the decision of the President Mursi according to which he appointed 3649 judges in the Supreme State Security Emergency courts, starting since last October.
The Egyptian Initiative depends, in the memorandum of the appeal, on the fact that the extraordinary powers vested to the president are based on just declaring the state of emergency. So, President Mursi misses the legal support that allows use such powers in case of the expiration of the state of emergency. Also, the State Security courts must consider such issues in such cases. In other words, the Judiciary authority must lead this legal process, not a presidential decision.
The lawsuit further demanded the cancellation of the presidential decision, issued last September, on the basis that it would dedicate the continuation of the notorious courts that are unable to ensure fair trials for the defendants.
